OPINION
SAND, District Judge.
Plaintiff Bobby Kent, proceeding pro se, first brought this action under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e et seq. in June, 1980, alleging that he was discharged by the defendant New York City Department of Sanitation (“City”) because of his race, color and religion. Prior to instituting this action, Kent had sought judicial review of his termination proceedings in the New York State courts pursuant to an Article 78 proceeding.
