DOYLE, District Judge.

Defendant Joseph Englert moves the Court to dismiss the complaints in this action. In support of this motion, defendant submits several arguments directed at some or all of the five claims set forth in the complaints.

Defendant urges upon the Court the contentions previously raised by the other defendants that the complaint fails to state valid claims for relief and that the Court lacks jurisdiction over the subject matter of each.
