Plaintiffs, Rebecca Roman (“Roman”) and Oleg Bondarev (“Bondarev”) seek review under the Administrative Procedures Act, 5 U.S.C. § 701 et seq. (“APA”), of the United States Citizenship and Immigration Service (“USCIS”) denial of their Form I-130, Petition for Alien Relative (“1-130 petition”) and the Board of Immigration Appeals’ (“BIA”) affirmance of USCIS’s decision.
