At the September term, 1911, of the Bell Circuit Court the appellee, Andy Hughes, was indicted for the 'shooting and killing of Jake Ban Bever; the crime charged being voluntary manslaughter. At the same term of the court appellee executed the required bail bond and entered a plea of not guilty; thereupon the case was continued.
