Appeal from a judgment of the Supreme Court (Ceresia, Jr., J.), entered September 9, 2003 in Albany County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to review a determination of the Board of Parole denying petitioner’s request for parole release.

Petitioner’s extensive criminal history and prior dealings with the Board of Parole are set forth in our decision in Matter of Moore v Travis (304 AD2d 1001 [2003], affd 2 NY3d 748 [2004]). He currently challenges the Board’s denial of his request for parole release following an October 2002 hearing.…
