This is an appeal by Jerome Dudley O’Brien, defendant and third-party plaintiff, hereinafter referred to as appellant, from a judgment rendered in favor of C. Gordon Heiss, Heiss Hotel Company and Mayfair Hotel Company, third-party defendants, hereinafter referred to as respondents, in which action appellant sought to recover $2,500 actual and $25,000 punitive damages for allegedly false and fraudulent representations made by respondents in procuring from appellant a transfer of “whatever interest, if any,” appellant had in 149 shares of common stock and 299 shares of…
