This is an action in tort against a sheriff, certain of his deputies and the surety on his official bond, based upon what is alleged to have been an unlawful procuring of the issuance of a search warrant and upon the acts done under the search warrant so procured. A trial was had to a jury, which returned a verdict against the defendant sheriff, his deputy Duggan and the National Surety Company, the surety on the sheriff’s official bond, in the sum of two hundred fifty dollars.
