On August 16, 190-7, Andrew W. Gillespie, defendant in error, sued Patrick Mclnteer and Thomas Kennedy, plaintiffs in error, in the district court of Garfield county for the partition of a certain tract of 22 acres of land known as the “Mclnteer-Gillespie addition” to Enid. After answer and reply thereto filed, there was trial to the court and judgment for plaintiff, and defendants bring the case here.
