OPINION

BRETT, Judge:

Appellant, Dorothy Mae Stewart, hereinafter referred to as defendant, was charged in the District Court, Oklahoma County, Case No. CRF-75-3803, with the offense of Possession of Heroin With Intent to Distribute, in violation of 63 O.S.1971, § 2-401. The case was tried to a jury, defendant being convicted of the lesser included offense of Possession of Heroin. Punishment was assessed at ten (10) years’ imprisonment. From said judgment and sentence a timely appeal has been perfected to this Court.
