This is an appeal from the district court for Red Willow County. The defendant-appellant, Cecil M. Byrd, was charged by information with distributing, delivering, or dispensing marijuana in violation of Neb. Rev. Stat. § 28-416(l)(a) (Reissue 1985), a Class III felony. Defendant pled not guilty, and the case was tried before a jury. On October 14, 1987, the jury returned a verdict of guilty. Defendant’s motion for new trial was overruled, and he was later sentenced to 1 year’s imprisonment. Defendant timely appealed.
