Appeal from a judgment of the Supreme Court (Lamont, J.), rendered May 3, 1996 in Ulster County, convicting defendant upon his plea of guilty of the crimes of assault in the second degree and aggravated unlicensed operation of a motor vehicle in the first degree.

In August 1995, defendant was indicted for the crimes of assault in the second degree, aggravated unlicensed operation of a motor vehicle in the first degree, two counts of criminal mischief in the second degree, resisting arrest and operating a motor vehicle while ability impaired.
