OPINION and ORDER

ALLEGRA, Judge:

Plaintiffs seek to dismiss their Third Claim for Relief, without prejudice, in accordance with RCFC 41(a)(2).

Plaintiffs initially brought this case in 2001, seeking just compensation under the Fifth Amendment and damages for a breach of the Klamath Basin Compact. On March 24, 2003, plaintiffs filed their first amended complaint, adding a breach of contract claim.
