Affirming in part and reversing in part.
C. R. Babb on May 7,1935, owned a tract of land in Livingston County, and on the day named he and his wife executed a mineral lease to appellants Roberts and Frazier, who afterwards took in other parties as partners. The lease was to run for a period of twenty years, “or as long thereafter as ore is found and mined in paying quantities.” Lessees were granted the right of entering, prospecting for, developing and mining fluorspar and other minerals on the following terms:(1) Lessees agree to pay fifty dollars…
