Plaintiffs-appellants Geneal Warf and Glenn Gupton 1 (“the Warf appellants”), individually and on behalf of a class of 542 absentee voters, appeal the district court’s order denying their motion for a preliminary injunction and granting summary judgment to defendants-appellees the Board of Elections of Green County, the Chairperson 2 and Members of the Board of Elections, the county of Green County, Kentucky and Billy Joe Lowe, on the Warf appellants’ 42 U.S.C. § 1983 claim of un constitutional disenfranchisement.
