Plaintiff executor seeks to have his testa-

tor’s will construed, and ask the court to declare his duties thereunder. After the usual first item directing the payment of debts and funeral expenses, testator provides in Item 2 that:

“Item 2. All the rest, residue and remainder of my estate, be the same real, personal or mixed, wheresoever situate and whether now owned or hereafter acquired, I give, devise and bequeath to Glenn G. Moysey, Jr., in Trust *28for the benefit of those children of mine living at the time of my death. I now have fonr children [naming them] * * *, and it is my intention…
