Plaintiff and appellant Danny R. Young filed a complaint for damages for assault and battery and intentional infliction of emotional distress. Respondent Libbey-Owens Ford Company and James Montrie were named as defendants. The first cause of action alleged Montrie, as employee of respondent, acting within the scope and course of his employment, assaulted appellant, also an employee of respondent, by purposefully striking appellant, a grievance man for the local union, with an electric cart Montrie was driving.
