Defendant Garcia was convicted of possession of heroin in violation of section 11500, Health and Safety Code. He has appealed from the judgment and order denying the motion for a new trial.

On the evening of November 26, 1957, Officer AVoodring of the Monterey Park Police Department, observed three young men emerge from a car that he had had under intermittent surveillance and enter a restroom of a service station.
