OPINION OF THE COURT

2Per curiam

1. INTRODUCTION

The Government of the Virgin Islands [“government” or “appellant”] appeals the order of the Territorial Court dismissing the first of three counts 2 of an information filed against Albert John [“John” or “ap- pellee”]. For the reasons set forth below, the Court will vacate the order of the Territorial Court.

II. FACTUAL AND PROCEDURAL HISTORY

In count I of the amended information against John, the government charged John with child abuse under the first charging phrase of section 505 of title 14 of the Virgin Islands Code, which provides in pertinent part that…
