OPINION OF THE COURT

HODGE, Chief Justice
Nathan McIntosh appeals from a Judgment and Commitment1 of the Superior Court of the Virgin Islands adjudging him guilty of two counts, including one count each of possession of a controlled substance with intent to distribute and introduction of narcotics into a prison.2 Because *675McIntosh was impermissibly convicted of two offenses based on the same act, we will remand the case for the trial court to determine which of the two convictions it will stay.
