Kenna, Judge:

This proceeding was brought before a justice of the peace in Raleigh County for the purpose of recovering for a personal injury under what may be terméd an industrial insurance policy. Judgment in favor of the plaintiff for three hundred dollars was rendered November 21, 1942. Defendant appealed to the Circuit Court, and the matter was submitted under an agreed statement of facts, the judge acting in lieu of a jury, and from a finding and judgment for the plaintiff, this Court granted a writ of error.
