On May 10, 1937, appellant, who was plaintiff in the Court below, filed in the Circuit Court of Duval County, Florida, his bill of complaint against Analee Moore MacQueen, his said wife. The Bill of Complaint alleged that plaintiff was a resident of the State of Florida, County of Duval, and had been for a period of ninety days prior to May 10, 1937, and that the defendant resided at 900 Ninth Avenue West, Birmingham, Alabama.
