OPINION AND ORDER
LEISURE, District Judge.
This diversity action is currently before the Court on the parties’ cross-motions for a change of venue and summary judgment. Defendant Bernard Y. Wassel (“Wassel”), a Maryland resident, moves the Court, pursuant to 28 U.S.C. § 1404(a), for a change of venue to the United States District Court for the District of Maryland. Plaintiff Generale Bank, New York Branch (“Generale”), cross-moves the Court for summary judgment, claiming that there exist no disputed issues of material fact, and that it is entitled to judgment as a matter of law.
