Appellant, Ike Jackson, was tried on information charging him with murder in the first degree, found guilty of murder in the second degree and his punishment fixed hy the jury at imprisonment in the penitentiary for seven years. To reverse the judgment of the lower court imposing sentence in accordance with the jury’s verdict appellant prosecutes this appeal.

These grounds for reversal are urged by appellant in this court: (1) That the lower court erred in refusing appellant’s requested instruction No. 9; (2) that there was not' sufficient proof to establish that the gunshot wound inflicted on…
