In an action, inter alia, for indemnification, the defendant *418appeals, as limited by his brief, from so much of an order of the Supreme Court, Nassau County (Kohn, J.), dated March 26, 1996, as granted the plaintiffs cross motion for summary judgment on its first and second causes of action.
Ordered that the order is modified, on the law, by deleting the provision granting the branch of the plaintiffs cross motion which was for summary judgment on its first cause of action for common-law indemnification, and substituting therefor a provision denying that branch of the motion; as so modified,…
