In this appeal the controlling issue is whether the exclusivity clause of the Worker’s Compensation Act is applicable to bar a tort action against a hospital and its nurse by an employee who was exposed to tuberculosis during the course of her employment and who later discovered that the hospital’s employee health monitoring program, available only to employees of the hospital, had failed to detect timely and treat properly her disease.
