Eeversing.
In this action for false arrest, Enoch 'Creech recovered a judgment against the Louisville & Nashville Eailroad Company for $500.00. The company appeals.
The facts are these: Appellee was a carpenter in the employ of the railroad company. On the 17th of -September, 1922, he and a -companion, Eobert Tharp, spent the night with a friend at Wolf Creek in Breathitt county.
