Reversing in Part and Affirming in Part.
Deraps Goins brought this suit against T. J. Hudson, jailer of Whitley county, and his surety, the Fidelity & Deposit Company of Maryland, to recover damages for false arrest and imprisonment. At the con elusion of the evidence for plaintiff, the court directed a verdict in favor of the surety. The case against the jailer was submitted to a jury, which returned a verdict in his favor. Goins appeals.
