Cross appeals from an order of the United States District Court for the Western District of New York (Arcara, J.), which adopted in toto the report and recommendation of Magistrate Judge H. Kenneth Schroeder, Jr. In sum, the district court granted summary judgment to defendants Railcar Custom Leasing, LLC (“RCL”) and ECDC Environmental, LC (“ECDC”), and dismissed plaintiffs’ complaint.
