This was an information in the name of the-State, on the relation of Jeremiah Pitman,, against the appellee. The facts stated in the information are, that on the 12th. day of March, 1873, Pitman was appointed and commissioned,', by. the governor prosecuting attorney for the tenth judicial; circuit, and on the 15th day of said month gave bond, was. sworn, and entered upon the discharge of the duties of the • office.
