Petitioners, the State of Illinois, the Illinois Commerce Commission, and Patrick Simmons, Illinois Legislative Director for United Transportation Union, (hereafter collectively referred to as “state agencies”), seek review of an Interstate Commerce Commission decision denying their petition to reopen a railroad merger proceeding. The state agencies had requested the Commission to reopen Louisville & Nashville Railroad Company — Merger — Monon Railroad, 338 I.C.C. 134 (1970) and to extend the term of a condition imposed in that case.1 That condition…
