WIEAND, Judge.

This is an action by a would-be legatee against a lawyer who failed to have a will executed by the testator prior to the testator’s death. A jury found that the lawyer’s failure consti tuted a breach of a third party beneficiary contract and awarded damages to the would-be beneficiary. The trial court denied post-trial motions, and judgment was entered on the verdict. After careful review, we reverse.
