Plaintiffs (petitioners) Joseph W. and Roni Gebert, devisees and legatees under the will of Edward Dolson Gebert, brought an action against defendant (respondent) Rosemary M. Gebert pursuant to Probate Code section 851.5. Petitioners claimed a half interest in certain real and personal property which had been held by Edward Gebert and his wife, Rosemaiy, respondent herein, in joint tenancy. Trial was by the court, sitting without a jury. Judgment was awarded in favor of petitioners. Respondent Rosemaiy prosecutes this appeal from the judgment.
