Before the court is an application to hold defendant in contempt. The motion is unopposed. On the return date of the instant motion, plaintiffs counsel advised the court, in writing, that defendant sought relief pursuant to chapter 7 of the United States Bankruptcy Code. Although defendant’s counsel was engaged before another judge, defendant, in court, acknowledged the filing.
