Christopher Aughney, Administrator of the estate of his deceased daughter McKenzie Aughney, appeals from the judgment of Henry County Court of Common Pleas, dismissing on a motion for summary judgment, his tort action against: the Henry County Department of Human Services (HCDHS); James Levinson, Director, Diana Toth, Kelly McMaster, Renee Petzoldt and Henry County Commissioners: Richard Bennett, Richard Bertz and Rita Franz.
