Defendant was charged with assault with intent to murder, and was convicted of an assault with a deadly weapon. He appeals from the judgment and from an order denying him a new trial.
1. The person upon whom the assault was committed was one Clara, an Indian woman, who was at the time living with defendant as his wife.
