CHATFIEED, District Judge.

The present action raises a pure question of fact, as there is a definite contradiction of testimony between the principal witnesses, with corroboration of the story of each.

The libelant first brought an action in rem. This court in The Convoy, 257 Fed. 843, disposed of certain legal questions presented upon that libel as drawn, but which were not dependent upon the' taking' of testimony. The libelant thereafter changed his action to one in personam, and sued for the sum of $1,118, for work, labor, and services in raising, pumping out, and delivering to a dry dock…
