Appeal by the defendant, the Home Life Insurance Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 21st day of November, 1910, upon the verdict of a jury rendered by direction of the court, and also from an order entered in said clerk’s office on the 23d day of November, 1910, denying the defendant’s motion for a new trial made upon the minutes.

Laughlin, J.:

The plaintiff has recovered on a policy of insurance issued by the defendant on the life of her husband, in which she was designated as the beneficiary. The policy was issued on the 27th ' day of February, 1906, at which time a premium of twenty-seven dollars and ninety cents was paid' as a term rate premium covering the period -until the twenty-seventh day of August thereafter, from which time it was provided that an annual premium of one hundred and twenty-nine dollars and twenty-five cents should be payable annually in advance.
