BIRCH, Circuit Judge:
Tho Van Huynh (“Huynh”) appeals the judgment of the district court denying his petition for habeas corpus relief filed pursuant to 28 U.S.C. § 2254. Huynh was convicted of robbery, felony murder, and malice murder. He enumerates in his petition three grounds that he contends warrant habeas relief: (1) ineffective assistance of counsel, (2) insufficiency of evidence to support his conviction for malice murder, and (3) double jeopardy. For the reasons that follow, we reverse the district court’s order, direct that the writ be granted with respect to Huynh’s armed robbery…
