1. Several errors are assigned relative to the instructions given and refused by the trial court. The bill of exceptions, however, consists in a mere recital of them withoiit any evidence collated with respect to any of them. The only means by which the testimony in the case is brought to our attention is by a complete stenographic report of all the utterances of the witnesses, court and counsel during the trial, annexed to the bill of exceptions as an exhibit.
