Appellee, plaintiff below, instituted this suit in the District Court of McLennan County against the appellant Barclay and one Frank Mabry, to recover of the defendants $8180, alleging that on the 20th day of March, 1906, the appellant sold to the appellee the entire capital stock of the McGregor National Bank, being of the value of $40,000, and that at the time appellant represented to appellee that the books of the McGregor National Bank correctly showed the amount due it by other banks, and that said books were correctly kept, but that, as a matter of fact, said books…
