This suit was brought by appellant Kuhl-mann and thirty-three other owners of property situated in the appellee drainage district to prevent the collection of taxes on. theii; property by both appellees, Harris county drainage district No, 12 and the city of Houston.

The petition alleges in substance that after-the organization of the drainage district the-city, without the consent of the owners of the property affected thereby, extended its boundaries so as to include a portion of the drainage district; that the city has taken over and is utilizing the ditches within the-city limits which…
