LONG, Presiding Judge.

The State of Alabama filed this petition for a writ of mandamus requesting us to *915direct Judge Robert Kendall, circuit judge for the Thirteenth Judicial Circuit, to vacate the order granting Carroll H. Sullivan’s motion to dismiss the perjury charge against him.1 Sullivan had been indicted for first-degree perjury by the Mobile County grand jury that was convened in October 1998.
