Plaintiff’s intestate was, at the time of the injury, in the employment of the defendant in the capacity of yard-master and conductor. His duties were, to see all the cars that were loaded, and place them at points as directed, take all empty cars, and deliver to the roads to which they belonged, see the numbers of all cars, and return them to the superintendent every morning.
