OPINION GRANTING DEFENDANT’S MOTION FOR SUMMARY JUDGMENT

Before this Court is the Motion for Summary Judgment (the “Motion”) of Defendant, American Federated Title Corporation (“AFTC”). The Motion was filed on April 21, 2010, pursuant to Fed.R.Civ.P. 56, as incorporated into bankruptcy practice by Fed. R. Bankr.P. 7056. The Defendant avers that no genuine issues of material fact exist for any of the remaining counts of the complaint.
