Marie Aores, a pedestrian, was struck by a locomotive of the defendant at the intersection of Mission avenue and defendant’s railroad tracks, in the city of Spokane. Plaintiff instituted this action to recover for the personal injuries sustained as a result of that accident. The trial court reduced by five hundred dollars the verdict returned in favor of the plaintiff. From the judgment entered on the verdict as reduced, motions for judgment notwithstanding the verdict and for a new trial having been overruled, the defendant appealed.
