VAN VALKENBÜRGH, Circuit Judge.

Appellant, plaintiff below, sued appellee, defendant below, for patent infringement, praying for injunction, accounting, and damages. Erom a decree below dismissing its bill appellant brings this suit.

Appellant is the owner of letters patent No. 1,560,248, issued November 3, 1925, to Harry Kerr, for an improvement in gas burners, and more particularly in a burner of the type disclosed in letters patent theretofore issued to W. J. Barber, No. 1,267,355, in which two streams of gas are commingled and caused to bum without initial admixture with air. The object…
