Plaintiffs Gerrit Rossien and his wife Coby were injured in an automobile accident at about 1:30 o’clock in the afternoon of June 28, 1941, on US-31, about four and one-half miles north of the city of Holland. They commenced separate suits against defendant Paul Berry and the two cases were consolidated for jury trial. The issues of fact as to defendant’s negligence and plaintiffs’ contributory negligence were submitted to the jury, resulting in a verdict of no cause for action.
