ORDER

PETTINE, Senior District Judge.

This is an appeal from the Magistrate’s order denying Plaintiff’s Motion for a Jury Trial. For the reasons stated below, that Order must be vacated in part.

Plaintiff alleges that the General Dynamics Corporation (through its agents McGuffie and Stanley) terminated his employment because of his membership in the Massachusetts National Guard. If this allegation is true, the defendants have violated both the Veteran's Reemployment Rights Act, 38 U.S.C.A. §§ 2021-2026 (1979 & 1982 supp.), and R.I.Gen. Laws § 30-11-6 (1982 reenactment).
