This is a motion to continue an injunction pendente lite. The facts appear to be substantially as follows, viz.: Plaintiff is the owner of premises Nos. 697 and 699 West End avenue, in the borough of Manhattan and city of New York, upon which premises is a first-class apartment-house, containing twenty apartments, which rent severally for $1,000 to $1,500 per annum. The defendant is a contractor, engaged in the removal of rock, by blasting and carting away the fragments of such rock, from certain vacant lots adjacent to the said premises of the plaintiff.
