HUDSON, Judge.

In May 2001, after a pre-disciplinary hearing, petitioner Hilliard was demoted by his employer, the North Carolina Department of Corrections (“DOC”), from his position as superintendent in charge of the Davidson County Correctional Center (“DCC”). Hilliard filed a contested case petition with the Office of Administrative Hearings (“OAH”) and DOC filed a motion for summary judgment. On 15 December 2001, Senior Administrative Law Judge, Fred G.
